The following are the terms (“Terms”) on which Valour Watch Company LTD (“Valour”) also referred to as (“we”, “our” or “us”) have agreed to supply watch or watch accessories (“Goods”) to you (“you” or “your”)shall be construed accordingly.

1.THE COMPANY

Valour creates, designs and markets limited edition timepieces (watches) worldwide selling primarily via the company e-commerce
website.

2.ORDERING

2.1

An order may be placed with us for Goods either by telephone, via the website, or in person(each an “Order”). With this order, you areoffering to buy Goods and we will acknowledge receipt of the order by email.

2.2

On review of the order, we will contact you again via email as confirmation of your order and a contract for goods will be in place.

2.3

You shall be responsible for determining that any order confirmation received by you from us is accurate.

2.4

If for some reason the Goods that you have ordered are no longer available or mistake has been made in pricing or total order cost calculation we will quickly advise you of this. In this case, you will not receive a confirmation email for the order and nocontract for Goods will be in place.

2.5

We have made every effort possible to accurately display the aesthetics and colours of our watches and accessories that appear on the company website. However, we cannot guarantee that the display monitor you view it on accurately reflects the actual Goods.

2.6

We have endeavoured to make all the information provided as accurate as possible and done so in good faith.

2.7

The contract undertaken on receipt of the order confirmation is governed by English Law and the English courts.

2.8When placing an order with us you agree to and accept these terms as well as our privacy policy and terms of website use.

3. PLACING AN ORDER

3.1

For orders received after November the 20th, 2014 full payment will be required when the order is placed.

3.2

You may browse the website without registering for an account, however, to place an order via the company website you must first register for a Valour account and receive your login details. Once logged in you will be able to add the selected products to your basket. Any items you do not require during the purchasing process can be removed from your basket at any time.

3.3

If you prefer to order by telephone you are free to do so by calling between the hours of 10am – 1pm and 2pm - 4:30pm UK Time, Monday to Friday.

3.4

Carriage charges will be shown prior to you finalising and placing your order.

3.5

For International customers outside the EU (European Union) or where UK VAT might not be charged, the price excluding VAT will be shown. Carriage charges in this instance will also be accompanied by an estimate of the customs and duty taxes required to receive the goods in your country of residence. Valour offers a full duty and taxes paid delivery service so our customers do not have to deal with customs in order to receive their goods.

3.6

For customers paying deposits, your duties and taxes are indicative costs and will only be finalised at the time of your balance payment using the current currency exchange rates on that day.

3.7

We use secure payment facilities for online purchases and accept most debit and credit cards. Please note that individual terms of your card issuer may apply. If you do not wish to pay online then arrangement for direct remittance payment is also available upon request.

3.8

Any promotional prices will only apply during the period stated.

3.9

All prices quoted on our website are in UK pounds and are shown inclusive and exclusive of VAT. Any currency conversions shown will be purely an indication and based on the current exchange rate at the time.

3.10

Once your order is confirmed, any changes may not be possible and requests for order adjustments must be put in writing via email or by contacting the company by telephone.

3.11

Once your order is complete we will notify you of the estimated despatch date and continually update you on the timeline for delivery.

4. DELIVERY AND CARRIAGE CHARGES

4.1

The Valour Sopwith Aviator Series 1 limited edition timepieces are produced in a single batch of 200 pieces. The estimated timeline for first customer deliveries to begin is in December 2014. Valour will constantly provide its customers with the latest information regarding the exact despatch and delivery dates.

4.2

If an order is placed at a time when the Goods are in stock then delivery times are 2-5 days for UK and Europe, 5-10 days for the rest of the world with international items shipped via DHL. Domestic items are also shipped with DHL.

4.3

Valour timepieces purchased on the website or via telephone can be delivered almost anywhere in the world, however we reserve the full right to not ship our products to certain locations if we decide to do so.

4.4

Shipping is calculated at the checkout and we shall deliver the Goods to the shipping address that you provide- this cannot be a PO Box.

4.5

We will deliver the goods to the premises you specify on your order but this must also be your billing address due to the cost of the product. You must be at this address to accept delivery of your order.

We will not accept responsibility for the loss or damage if you instruct the delivery company to leave the Goods unattended.

4.6

You cannot change the delivery address once the goods have been dispatched to you as this will be different to the billing address. We reserve the right to stop the shipment if an address change is requested until the matter has been resolved. In the event that a customer refuses to have the items delivered to the original billing address Valour reserves the right to terminate the delivery and pass on any extra charges for the re-direction and subsequent return of the goods.

In the event of such a situation and if the delivery and billing address issue remains unresolved Valour reserves the right to cancel the order and refund the customer any monies already paid minus the costs for the delivery redirection and return.

4.7

You must check the goods on delivery and any goods that are found to be missing or damaged should be declared to the delivery driver or Valour by phone or email at the time of delivery or no later than 1 day after delivery.

4.8

When external factors beyond our control prevent the timely delivery of your goods such as accidents, fire, flood, severe weather or the default of our suppliers then we endeavour to rectify the delivery situation as best we can and keep you informed during the process. However,we cannot be held responsible where this causes delays or even a failure in delivering your goods.

4.9

For customers in countries outside the EU (European Union) or VAT applicable zones, your delivery may be subject to customs clearance and this will require the payment of customs and duties tax at the border. This however is all pre-arranged by Valour Watch Company as you will have made payment to cover these costs when purchasing from us due to the integrated customs and duties program in our checkout system. With this, you will receive a completely hassle free delivery via our international courier service provider DHL.

 

Please note:
There are a few exceptions for particular countries where the detailed customs information is unavailable to us. In this situation, Valour will advise you after completingthe order if a duty and taxes paid delivery is possible or if you will need to deal directly with customs when the goods arrive at the border.

4.10

All timepiece deliveries are traceable via the carrier’s website, however if for some reason your delivery is not made within 12 days of it being dispatched then it is your responsibility to report this.

4.11

If the unusual situation arises where a customers limited edition timepiece is lost during delivery and cannot be located within a 30 day period of a customer’s non-delivery notification then Valour offers the customer the following options…

1) The replacement of the watch with a different limited edition number (if in stock). 2) The replacement of the watch with a bespoke manufacturing order to replace the original limited edition number. (Please note this option will take a minimum time of one ‘1’ month) 3) The option to cancel with a full refund of all costs incurred in placing the order with the additional offer of a discount on any future order. (Any discount offered will be solely at the discretion of Valour)
4.12

The Company considers the transaction complete upon you accepting the delivery to the agreed address as confirmed by our courier service.

5. CANCELLATION AND RETURNS

5.1

You may cancel your order up to 7 days after the delivery in which case you must email us and if possible also notify us by telephone to fully confirm the cancellation request. When confirmed, we will process your refund due to you as soon as possible after any cancellation confirmation, however not before Valour has inspected the returned goods.

5.2

You do not need to give any reason for your cancellation. However, any explanation that you provide will be of assistance to us.

5.3

If you are returning the Goods due to the fact that you consider the goods to be defective then we will fully examine the Goods returned and advise you if you have any right to a refund. We will usually process any refund due to you for faulty goods within 30 days from us notifying you of the refund. The price of the Goods returned to you due to a defect will be refunded in full and will include the cost of both sending the goods to you and the costs incurred by you in returning the goods to us.

5.4

Except where the Goods are deemed defective as covered in 5.3 all items must be returned in an unworn and undamaged condition with all original packaging, papers and associated items in place and also showing no signs of wear. The refund policy will only apply if all of the previously noted requirements are fulfilled. We take the returned condition of the product very seriously with an individual photographic record taken of all goods to note the condition prior to release to our customers. This photographic record will be used in the evaluation of any returned goods.

5.5

Any deposit taken by Valour to secure an order that is cancelled is fully refundable.

6. LIABILITY

6.1

We do not accept liability for any consequential loss of profit or indirect losses that result from our failure to meet these terms.

7. WARRANTIES

7.1

Your Valour timepiece, presentation box and all other associated items have been designed and manufactured with great attention to detail.All timepieces have been tested extensively and inspected to ensure that you receive a high quality product.

7.2

Although unlikely, if your timepiece develops a problem within the warranty period then please contact us to initially discuss the issue. If a technical issue can be resolved by a recommended watch technician in your area then Valour will arrange for and pay the associated costs in carrying this out.

In the specific case where the technical problem requires the return of the timepiece to Valour then we will arrange the pickup, servicing and return of it to you in perfect working order at no cost.

7.3

In addition to any warranties or remedies available under consumer laws or regulations, a Valour watch comes with a 2 year limited international warranty which commences from the date that we receive notification that the courier service has completed the delivery to you.

7.4

Your warranty covers material defects and any faults in craftsmanship. It does not cover any defects that are caused through improper use or through the effects of regular everyday wearing of the watch.

7.5

If we determine on inspection that the problem with your watch has been caused by improper use then we will contact you to discuss this. Indications of improper use may be seen through clear evidence of excessive impact forces being applied to the case components, removal of the case back and or obvious interference with the watch movement.

7.6

The warranty on your Valour timepiece will be deemed void if any non-Valour modifications or third party repair are carried out within the warranty period without the specific authorisation from Valour Watch Company.

8. MEMBERSHIP- VALOUR FLIGHTLINE

8.1

Valour Flightline is the exclusive membership available to the customers of Valour Watch Company and affords any holder the right to priority ordering on all future Valour offerings prior to public release.

8.2

The membership is only valid from the date of your first watch being delivered to you.

8.3

If you return the Goods after delivery for any reason other than the unlikely event that the goods are faulty then the status of your Valour Flightline membership will be changed to ‘inactive’. We will contact you further to confirm if you wish for usto retain your customer details.

8.4

When a new Valour timepiece is ready to be released for early sale to its Flightline members, each member has the opportunity to purchase a numbered limited edition watch before the series is released for public sale. In the event that a Flightline member does not wish to take advantage of the priority purchase then they can nominate another buyer who is not a member.

8.5

Valour reserves the right to remove a member’sFlightline status if the member violates any of the Company ‘Terms of Use for the Website’, ‘Terms of Business’ or interacts with the company in an unacceptable way either by email, telephone or other forms of oral or written communication.

9. PRIVACY AND SECURITY

9.1

We will not sell, rent, exchange or give your email address to anyone for the purpose of sending you marketing emails.

9.2

We do not disclose your contact information to any third parties other than for order processing, delivery and customer service or feedback purposes. We are totally committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998).

9.3

Online transactions are processed securely via our Payment Gateway and merchant account provider with all credit card details being encrypted when your order is placed.

9.4

If you wish to place an order over the phone then we do not store any credit or debit card details after the completion of your phone order. Once the details have been used to process the payment using our virtual terminal system all financial details are destroyed.
